The judge overseeing Donald J. Trump’s criminal case in Manhattan held him in contempt on Tuesday, fining the former president $9,000 for repeatedly violating a gag order and warning that he could go to to jail if he continued to attack witnesses and jurors. “The court will not tolerate continued willful violations of its lawful orders,” the judge, Juan M. Merchan, said as Mr. Trump’s trial reconvened for a third week. He added that while he was “keenly aware of, and protective of, defendant’s First Amendment rights,” he would jail Mr. Trump “if necessary and appropriate.”Justice Merchan determined that Mr. Trump had flouted the gag order by making nine public statements on social media and on his campaign website in which he attacked witnesses and the jury. He ordered Mr. Trump, the presumptive Republican nominee for president, to remove the posts by Tuesday afternoon. The judge’s ruling and admonition came one week after a fiery hearing in which prosecutors had argued that Mr. Trump’s statements threatened the trial.

Donald J. Trump appears to be a stronger candidate than he was four years ago, polling suggests, and not just because a notable number of voters look back on his presidency as a time of relative peace and prosperity. It’s also because his political liabilities, like his penchant to offend and his legal woes, don’t dominate the news the way they once did. In the last New York Times/Siena College poll, only 38 percent of voters said they’d been offended by Mr. Trump “recently,” even as more than 70 percent said they had been offended by him at some point. We didn’t ask a question like this back in 2016 or 2020 for comparison (unfortunately), but my subjective thumb-in-the-wind gauge says that, if we had, more voters would have said yes to the “recently offended” question. Mr. Trump’s most outrageous comments just don’t dominate the news cycle the way they did four to eight years ago.

CNN —Special counsel Jack Smith urged the Supreme Court on Monday to reject Donald Trump’s claims of sweeping immunity and to deny the former president any opportunity to delay a trial on charges that he attempted to subvert the results of the 2020 election. Trump’s position, Smith told the court, has no grounding in the Constitution, the nation’s history or Americans’ understanding that presidents are not above the law. Even if the Supreme Court finds that former presidents are entitled to some form of immunity, Smith asserted, at least some of Trump’s actions were private conduct – far removed from “official acts” – and could be prosecuted. The Supreme Court will hear arguments April 25, and a decision is expected by July. The Florida Supreme Court issued a separate ruling on Monday that could energize Democrats’ efforts to hold Trump to account on abortion. The ex-president has long been wary of taking a definitive stand against abortion rights. But some Republicans are infringing the spirit of the Supreme Court ruling – which sent the issue back to individual states – by pushing for a national ban. Referendums protecting abortion access are on a winning streak nationwide, including in states far more red than Florida. CNN —Former President Donald Trump has falsely claimed, again, that he had to post a bond in order to appeal a $454 million civil fraud judgment against him – and falsely claimed, again, that Judge Arthur Engoron did something unusual in forcing him to post a bond during the appeal process. Is a crooked New York Judge allowed to make you pay for the ‘privilege’ of appealing a wrongful & corrupt decision??? He was not required to post a bond in order to appeal Engoron’s ruling; he began the appeal process in February, more than a month before he posted the bond. And the requirement he actually faced – to post a bond to prevent collection during the appeal process – was not “a first” or some unusual requirement created by Engoron. In March, Trump falsely claimed this was an unprecedented Engoron requirement.

CNN —People seeking employment at the Republican National Committee have been asked in recent job interviews whether they believe the 2020 election was stolen, according to two sources familiar with the questioning. Use of the question comes after the Trump campaign has effectively merged its operations with the RNC. A key focus for the Trump campaign, and newly elected leadership at the RNC, ahead of the 2024 election is election fraud. Much of that focus stems from former President Donald Trump’s dissatisfaction with how the RNC handled claims of election fraud around the 2020 election, multiple sources familiar with the matter said. While chairwoman of the RNC, McDaniel refused to acknowledge that Biden won the 2020 election.

The White House reportedly plans to follow tradition and authorize national security briefings for Trump after he officially becomes his party’s nominee at the Republican National Convention in July. Serious financial need is a top reason for denial of clearances for federal government positions requiring access to classified national security information, due to vulnerability to bribery or coercion. Given the risks posed by Trump’s access to national security intelligence, we must ask whether Biden’s asymmetrical belief in sticking to political norms is an Achilles heel. In opting to provide intelligence briefings to candidate Trump, they are likely to impose conditions on the briefings for security reasons. In granting intelligence briefings to his rival, he clearly reasoned that preserving a nonpartisan tradition was the wisest decision at this difficult moment in the nation’s history.
